1. In general
Please read the Terms thoroughly before using the Site. By using the Site you accept these Terms.
The Site is made available by Comosa AG, Utoquai 43, 8008 Zürich, Switzerland and Central Business Reg. CHE-317.322.034 (“Comosa”).
www.worldboxingsuperseries.com (the “Site”) is an online service providing highlights and news from Comosa. The content of the Site includes livestreams, blogs, TV guide, etc.
Comosa may prevent you from accessing the Site if you fail to comply with these Terms or you act contrary to statutory provisions, or in the event that Comosa suspends or discontinues all or part of the Site.
2. The Site
The Site is made available to the user “as is”, including its current layout and content. Comosa makes no warranty as to the content or the use of the Site nor is Comosa responsible for delays or errors at the Site. The Site may be affected by circumstances beyond the control of Comosa and any error recovery may result in the Site being temporarily unavailable.
Comosa is not liable for costs incurred, any breach of law or other circumstance arising out of your use of the Site.
3. Age restriction
If you are under the age of 18 you may use the Site only subject to your parents’ explicit permission. Comosa is not liable for any loss or damage incurred by you or any other person owing to non-compliance with this provision. If you provide information at the Site, which is not true, Comosa is entitled to suspend your access. Parents permitting their children to use the Site are solely responsible for deciding what is appropriate for their children to access and to view as the Site is designed to appeal to a wide audience and the Site may therefore contain material unsuitable for children. Comosa does not warrant that third-party websites or applications to which the Site contains hyperlinks use and observe the same age restriction as Comosa.
4. Using the Site
When you use the Site, you must comply with these Terms and any applicable law. You are personally responsible for all your actions. The Site must not be used:
i) in any way that may harm or disturb other users;
ii) in any way that may cause damage to or interrupt the use of the Site;
iii) for unlawful purposes;
iv) in any way that may be considered to be defamatory, indecent, racist, ethnically offensive, vulgar, pornographic or in any other way intend to cause annoyance or inconvenience;
v) for transmission or uploading of computer viruses or other potential malware (files, software or data);
vi) as a means to harass, threaten, discriminate, take advantage of or in any other way offend others or for sharing, collecting, saving, displaying or in any other way take advantage of other people’s personal information or offend other people’s integrity;
vii) in any way that may constitute a violation or an infringement of the rights of a third party or an enterprise, including copyrights or other intellectual property rights;
viii) for commercial use; or
ix) for creating a false identity for the purpose of misleading third parties about the identity of the sender or the origin of the message.
When you use the Site, you may risk being exposed to material of an offensive nature. If you find any material offensive, please contact Comosa ([email protected]). Comosa does not generally review the material submitted by you or any other users. However, you consent to Comosa always being entitled to review and possibly remove material and information contributed by you and stop stop making the Site available to you.
5. Intellectual property rights
Any and all content at the Site is owned or licensed by Comosa and is protected by Swiss law on intellectual property rights. You are therefore prohibited to copy, publish, reproduce, lease, license, transmit, distribute or send the content of the Site to the public, or make it available to the public, or make others do so; or b) circumvent, remove, create derived works, disassemble or modify the Site or manipulate security, encryption, software and other technology that form part of the Site.
The names, images, logos, etc., of Comosa and any third parties belong to Comosa and the relevant third parties, and you are not entitled to use them. Any and all copyrights, trademarks and other intellectual property rights contained in the Site and any other material or content forming part of the Site are the property of Comosa or the relevant third party.
Infringement of these intellectual property rights will be deemed to constitute material breach of these Terms and will entitle Comosa to stop making the Site available to you with immediate effect and in any other way to prevent further misuse and to file a claim for damages against you.
6. Uploading content to the Site and linking
You may upload content to the Site by following the directions on the website. You are responsible for the content that you upload and whatever implications there may be by you not having the rights to the uploaded content.
When you upload content to the Site, you also declare that you own or have acquired the necessary rights, approvals, licences or other authorisations to upload and use the content.
You maintain the rights to the content you upload, but by uploading the content, you grant Comosa a non-exclusive right to use, distribute, reproduce and modify the content free of charge and with no territorial restrictions on its the websites, applications, etc., including of its consolidated companies. The right covers any kind of use in all types of formats and on all present and future platforms of Comosa. This right is indefinite.
Comosa may refuse to make the content uploaded by you available to the public and may, whatever the cause and without notice, remove the uploaded content. If you upload own material that proves to be unlawful, insulting or offensive or infringes the rights of a third-party, Comosa may notify the affected third parties.
You may establish links to the pages of the Site on the condition of that this is done legally and does not harm the reputation of Comosa or takes undue advantage hereof and provided that the following terms are complied with:
- The established links may not provide the impression of any approval by Comosa of the website from which linking is made;
- You may not establish links from a website you do not own; and
- The website from which linking is made must comply with the obligations with respect to content as stipulated in this point 6.

8. Limitation of liability
You consent to Comosa that Comosa is not being liable towards you or any other person for any loss or damage caused by or incurred as a result of these Terms or the use of the Site. This limitation of liability covers any damage and any loss, direct as well as indirect.
You agree to indemnify Comosa and any business partner of Comosa for any loss, damage, claim, costs and expenses incurred, including legal fees, as a result of or in connection with any non-compliance with these Terms and any breach of law or infringement of third-party rights on using the Site.
10. Force majeure
Comosa is not liable for the non-compliance or unavailability or the breakdown of the Site or any delays in complying with these Terms if such non-performance or inaccessibility or a failure to comply with the Terms is caused by circumstances beyond the control of Comosa.
11. Hyperlinks to third-party websites
Comosa is not responsible for the websites or applications to which the Site contains hyperlinks. These Terms apply to your use of the Site only and not to your use of any third-party website which you may visit/use based on a hyperlink at the Site.
12. Changes of the Terms
Comosa revises and updates these Terms on a current basis. The most recent date of such update always appears at the top of these Terms. If you continue to use the Site after the changed Terms have been made public at the Site, you accept the changed Terms. You are personally responsible for checking whether the Terms have been changed. If you cannot accept the current Terms, please do not use the Site.
You are not entitled to assign your rights or obligations under these Terms to any third party without the prior written consent of Comosa.
If any provision of these Terms should be deemed invalid or without enforceability the other provisions of the Terms will still apply.
15. Governing Law and Jurisdiction
The law of Switzerland applies to these Terms. The parties must first seek to resolve any dispute arising out of these Terms or the use of the Site through negotiation. If agreement cannot be reached by negotiation, the dispute must be settled by arbitration in Zurich, Switzerland in English.
